Rationality in the Confinement of Text: A Study of the Theory of al-Dalil as a Method of Istinbath al-Ahkam in Ibn Hazm's Thought
Abstract
This article examines rationality in Ibn Hazm's thought through the theory of al-Dalil as a method of istinbath al-ahkam, an important approach in Islamic jurisprudence used to extract law from religious texts. In this study, we identify how Ibn Hazm, with his rational approach, uses al-Dalil as a tool to interpret Islamic law contained in the Qur'an and Hadith, as well as its relevance in the context of modern fiqh methodology. This research uses a qualitative method with a critical textual analysis of Ibn Hazm's works, particularly in the books al-Muhalla and al-Ihkam. This study aims to explore how the theory of al-Dalil functions in constructing rational and systematic legal arguments in Ibn Hazm's thought. The research method used is an in-depth literature study of classical and modern texts relevant to the theme, as well as a comparative analysis between the views of Ibn Hazm and other fiqh thinkers. Three results found in this study are: first, Ibn Hazm emphasized the importance of strong and logical arguments in establishing law; second, the use of rationality in textual interpretation becomes a bridge between revelation and the practice of social life; third, Ibn Hazm's firmness in rejecting weak or unfounded interpretations. The discussion includes the application of al-Dalil in various legal contexts, its relevance to the development of contemporary fiqh thought, as well as criticism of thoughts that are not based on strong arguments. In conclusion, the theory of al-Dalil in Ibn Hazm's thought makes a significant contribution to a rational and text-based understanding of Islamic law.
